What Do You Mean by Apostille? | Tennessee Apostille Help

What Do You Mean by Apostille?

If someone told you that your document needs an apostille, you may be wondering what that actually means and where to start.

Apostille requests can feel confusing because the process often depends on the type of document, where the document came from, which country will receive it, and whether the document needs to be notarized first.

One of the most common questions people ask is: What do you mean by apostille?

In simple terms, an apostille is a certification used for documents that will be presented in another country. It helps confirm that the signature, seal, or certification on the document came from the proper public official.

What Does Apostille Mean?

An apostille is a special certification attached to a document for international use.

It does not prove that the information inside the document is true. Instead, it verifies the official signature, seal, or certification connected to the document.

For example, if a document is notarized in Tennessee, the apostille does not confirm the truth of the document itself. It confirms the Tennessee notarial or official authentication chain attached to that document.

This is why apostille requests often involve more than one step. A document may need to be notarized, authenticated by the County Clerk, and then submitted to the Tennessee Secretary of State for the apostille.

Can a Notary Do an Apostille?

No. A notary does not issue an apostille.

In Tennessee, apostilles are issued by the Tennessee Secretary of State for eligible documents. However, a notary may still be an important first step if the document needs to be signed and notarized before it can be submitted.

A notary can notarize the signer’s signature when the document requires notarization. After that, the notarized document may need to go through the proper authentication steps before the apostille is issued.

Can Any Notary Do an Apostille?

A notary can help with the notarization portion, but the notary does not create or issue the apostille.

For a Tennessee apostille, the Tennessee Secretary of State must be able to authenticate a Tennessee official signature, seal, or certification connected to the document. According to the Tennessee Secretary of State, apostilles and authentications are issued for documents executed, issued, or certified by Tennessee County Clerks, the Tennessee State Registrar, and the Tennessee Secretary of State.

So the document does not always have to be “about Tennessee,” but the Tennessee authentication process must involve a Tennessee official signature or certification that the state can verify.

Can a Notary Provide an Apostille?

A notary may provide apostille support or apostille courier service, but that is different from issuing the apostille.

The notary can help with practical steps such as:

  • notarizing the document, if notarization is required
  • helping you understand whether county clerk authentication may be needed
  • couriering eligible documents to the County Clerk
  • submitting eligible documents to the Tennessee Secretary of State
  • returning the completed apostille packet to you

The actual apostille is issued by the Tennessee Secretary of State, not by the notary.

What Can a Notary Do Before an Apostille?

A notary can notarize the document if the document requires notarization.

Before the notarization, the signer should confirm what type of notarial certificate is required. The receiving party may ask for an acknowledgment, a jurat, or specific notarial wording.

An acknowledgment means the signer is confirming that they signed the document willingly.

A jurat means the signer swears or affirms that the contents of the document are true. A jurat must be signed in front of the notary, and the signer must take an oath or affirmation.

For international documents, it is also important to ask whether the receiving party will accept a separate notarial certificate attached to the document or whether the wording must appear directly on the document itself.

Can I Apostille My Birth Certificate?

A birth certificate is handled differently from a private document that is signed and notarized.

A notary generally does not notarize a birth certificate for apostille purposes. Birth certificates usually need to be certified copies issued by the proper vital records office.

If your birth certificate was issued in Tennessee, you would typically need a certified Tennessee vital record before submitting it for apostille. If your birth certificate was issued in another state, you usually need to follow that state’s apostille process.

This is why it is important to know where the document was issued before beginning the apostille process.

Can I Get an Apostille in Tennessee?

Yes, if the document is eligible for a Tennessee apostille.

For notarized documents, the usual Tennessee process includes:

  1. The document is properly signed and notarized by a Tennessee notary.
  2. The County Clerk authenticates the Tennessee notary’s signature.
  3. The completed document packet is submitted to the Tennessee Secretary of State for the apostille.

The Tennessee Secretary of State’s apostille guide explains that, before submitting a notarized document for an apostille or authentication, the notary’s signature must be authenticated through the appropriate County Clerk step.

Only one apostille is typically issued for the completed document packet. The County Clerk authentication page does not receive its own separate apostille, but it stays attached as part of the supporting certification.

Can I Do an Apostille Myself?

Yes, in many cases you can complete the apostille process yourself.

However, apostille requests can be confusing if you are not sure what the receiving country requires or which office must handle each step.

Documents may be delayed or rejected if they are incomplete, notarized incorrectly, missing the proper county authentication, or submitted to the wrong state office.

Before starting, it helps to know:

  • what country the document is going to
  • what type of document you have
  • where the document was issued
  • whether the document needs notarization
  • whether the receiving party requires specific wording
  • whether county clerk authentication is needed
  • whether there is a deadline for delivery or return

If you are unsure, it is better to ask questions before mailing or submitting the document.

How Quickly Can I Get an Apostille?

The timing depends on the document, the required steps, the receiving country’s requirements, and the current processing time at the office issuing the apostille.

Some documents need only one step. Others may require notarization, county clerk authentication, and Secretary of State submission.

If the document is incomplete or notarized incorrectly, the process can take longer because the document may need to be corrected before it can be submitted again.

For that reason, the best first step is to review the document, confirm the destination country, and find out whether the receiving party requires specific notarial wording.
